EPR registration is a process of obtaining the approval of the Central Pollution Control Board (CPCB) or the State Pollution Control Boards (SPCBs) for the implementation of the extended producer responsibility (EPR) obligations under the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016. EPR is a policy approach that makes the producers, importers and brand owners (PIBOs) responsible for the collection and management of the waste generated from their products, such as electrical and electronic equipment (EEE) or plastic packaging. EPR registration is required to ensure that the waste is managed in an environmentally sound manner, and that the PIBOs comply with the EPR targets, standards and guidelines set by the CPCB or the SPCBs. EPR registration is also a legal requirement under the Environment (Protection) Act, 1986 and the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016.

Applicable Rules/ Acts/ Regulations for EPR 

The legal framework for EPR registration is as follows:

  • The Environment (Protection) Act, 1986, which is the umbrella legislation that empowers the central government to take measures to protect and improve the quality of the environment and prevent, control and abate environmental pollution. The act also provides for the establishment of the National Environmental Appellate Authority, which hears appeals against the orders of the central government or any authority under the act. The act also lays down the penalties for contravention of the provisions of the act or the rules made thereunder.
  • The E-Waste (Management) Rules, 2016, which are the specific rules that regulate the generation, collection, storage, transportation, segregation, refurbishment, dismantling, recycling and disposal of e-waste in India. The rules also define the roles and responsibilities of various stakeholders, such as producers, consumers, bulk consumers, collection centres, dealers, e-retailers, refurbishers, dismantlers, recyclers and producer responsibility organizations (PROs). The rules also specify the EPR targets, the procedure for obtaining EPR authorization, the standards for environmentally sound management of e-waste, the criteria for registration of PROs, the format and frequency of reporting, and the procedure for monitoring and enforcement.
  • The Plastic Waste Management Rules, 2016, which are the specific rules that regulate the generation, collection, storage, transportation, segregation, processing and disposal of plastic waste in India. The rules also define the roles and responsibilities of various stakeholders, such as producers, importers, brand owners, consumers, waste pickers, recyclers, local bodies and gram panchayats. The rules also specify the EPR targets, the procedure for obtaining EPR registration, the standards for plastic waste management, the criteria for registration of plastic waste processors, the format and frequency of reporting, and the procedure for monitoring and enforcement.
  • The Guidelines for Implementation of E-Waste (Management) Rules, 2016, which are the guidelines issued by the CPCB to provide clarity and guidance on the implementation of the E-Waste (Management) Rules, 2016. The guidelines cover various aspects, such as EPR plan, collection mechanism, channelization, documentation, record keeping, reporting, verification, random sampling, testing, labelling, awareness generation, capacity building, and grievance redressal.
  • The Guidelines on Extended Producer Responsibility for Plastic Packaging, which are the guidelines issued by the CPCB to provide clarity and guidance on the implementation of the Plastic Waste Management Rules, 2016. The guidelines cover various aspects, such as EPR plan, collection mechanism, channelization, documentation, record keeping, reporting, verification, plastic credits, eco-fee, and grievance redressal.

Eligibility/ Pre-Licensing/ Mandatory Prerequisites

The eligibility, pre-licensing and mandatory pre-requisites for obtaining EPR registration are as follows:

  • The applicant should be a producer, importer or brand owner (PIBO) of electrical and electronic equipment (EEE) or plastic packaging, as defined under the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016.
  • The applicant should have a valid PAN card and GSTIN.
  • The applicant should have a valid consent to establish or consent to operate or authorization or registration or license or any other document that indicates the approval of the concerned regulatory authority for the manufacture or import or sale or distribution of EEE or plastic packaging.
  • The applicant should have a valid agreement or MoU with the registered collection centres, dealers, e-retailers, refurbishers, dismantlers, recyclers, producer responsibility organizations (PROs) or any other entity for the collection and management of e-waste or plastic waste generated from their products.
  • The applicant should have a valid agreement or MoU with the authorized transporters for the transportation of e-waste or plastic waste as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
  • The applicant should have a valid agreement or MoU with the authorized treatment, storage and disposal facilities for the disposal of hazardous wastes generated from e-waste or plastic waste as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
  • The applicant should have a valid agreement or MoU with the authorized testing laboratories for the testing of e-waste or plastic waste for RoHS parameters or plastic identification code or any other parameter as specified by the CPCB or the SPCBs.
  • The applicant should have a valid agreement or MoU with the State Pollution Control Boards or the Pollution Control Committees or the Union Territory Administration for the coordination and cooperation in the implementation of the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016.

Documents Required for EPR Registration

The documents or information that need to be submitted along with the application for EPR registration are as follows:

  • A duly filled and signed application form in the prescribed format (Form 1 or Form 1A) along with a declaration and an undertaking by the applicant that the information provided is true and correct and that the applicant will comply with the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016 and the guidelines issued by the CPCB or the SPCBs.
  • An EPR plan containing the detailed plan of the applicant for achieving the EPR targets set by the CPCB or the SPCBs for the products for which the EPR obligations are to be implemented. The EPR plan should also contain the details of the collection mechanism, the channelization mechanism, the documentation mechanism, the record keeping mechanism, the reporting mechanism and the verification mechanism to be adopted by the applicant. The EPR plan should be prepared as per the guidelines and formats issued by the CPCB or the SPCBs.
  • A copy of the consent to establish or consent to operate or authorization or registration or license or any other document that indicates the approval of the concerned regulatory authority for the manufacture or import or sale or distribution of EEE or plastic packaging.
  • A copy of the agreement or MoU with the registered collection centres, dealers, e-retailers, refurbishers, dismantlers, recyclers, producer responsibility organizations (PROs) or any other entity for the collection and management of e-waste or plastic waste generated from their products.
  • A copy of the agreement or MoU with the authorized transporters for the transportation of e-waste or plastic waste as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
  • A copy of the agreement or MoU with the authorized treatment, storage and disposal facilities for the disposal of hazardous wastes generated from e-waste or plastic waste as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
  • A copy of the agreement or MoU with the authorized testing laboratories for the testing of e-waste or plastic waste for RoHS parameters or plastic identification code or any other parameter as specified by the CPCB or the SPCBs.
  • A copy of the agreement or MoU with the State Pollution Control Boards or the Pollution Control Committees or the Union Territory Administration for the coordination and cooperation in the implementation of the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016.
  • Any other document or information that may be required by the CPCB or the SPCBs or the concerned regulatory authority for the appraisal of the proposed EPR plan.

How to apply for EPR Registration online in India?

  • Every Manufacturer in India who wants EPR Authorization should make an application in Form-1 of the E-Waste (M) Rules, 2016 and this application should be duly filled & accompanied with requested documentation.
  • According to these Rules the applicant must provide the duly-filled application to the Member Secretary (CPCB).
  • Form-1 should entail the legal information to the accumulation and channelization of E-Waste as mentioned under Section 2.1.1 to 2.1.7.

Cancellation/Validity/ Renewal of EPR

The cancellation, validity and renewal of the service involved in EPR registration are as follows:

  • Cancellation: The CPCB or the SPCBs may cancel the EPR registration granted to the applicant if it is found that the applicant has violated any of the terms and conditions of the EPR registration or has furnished false or misleading information or documents or has concealed any material fact or information. The CPCB or the SPCBs may also cancel the EPR registration granted to the applicant if it is found that the applicant has failed to achieve the EPR targets or has failed to comply with the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016 or the guidelines issued by the CPCB or the SPCBs. The CPCB or the SPCBs may cancel the EPR registration after giving a reasonable opportunity of being heard to the applicant and after recording the reasons for such action in writing. The CPCB or the SPCBs may also impose a penalty or take any other legal action against the applicant for such violation or misrepresentation or concealment.
  • Validity: The EPR registration granted to the applicant is valid for a period of one year for plastic packaging or five years for EEE from the date of issue or as specified by the CPCB or the SPCBs. The validity of the EPR registration is subject to the satisfactory performance and compliance of the applicant with respect to the EPR plan, the collection mechanism, the channelization mechanism, the documentation mechanism, the record keeping mechanism, the reporting mechanism and the verification mechanism.
  • Renewal: The applicant may apply for the renewal of the EPR registration at least three months before the expiry of the validity period of the EPR registration. The applicant has to submit the application for renewal along with the relevant documents and information and the processing fee to the CPCB or the SPCBs. The CPCB or the SPCBs may renew the EPR registration after appraising the application and the documents and information submitted by the applicant and after ensuring that the applicant has achieved the EPR targets and has complied with the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016 and the guidelines issued by the CPCB or the SPCBs. The CPCB or the SPCBs may renew the EPR registration for a further period of one year for plastic packaging or five years for EEE or as specified by the CPCB or the SPCBs.

Mandatory Compliance 

The applicant is required to comply with the following mandatory requirements attached with the service of obtaining EPR registration:

  • The applicant should comply with all the terms and conditions of the EPR registration granted by the CPCB or the SPCBs and should implement the EPR plan, the collection mechanism, the channelization mechanism, the documentation mechanism, the record keeping mechanism, the reporting mechanism and the verification mechanism as per the E-Waste (Management) Rules, 2016 or the Plastic Waste Management Rules, 2016 and the guidelines issued by the CPCB or the SPCBs.
  • The applicant should comply with all the applicable laws and regulations related to the e-waste or plastic waste management and should obtain and maintain the consent to establish or the consent to operate or the authorization or the registration or the license or any other document that indicates the approval of the concerned regulatory authority for the collection and management of e-waste or plastic waste.
  • The applicant should conduct regular monitoring of the e-waste or plastic waste parameters and should submit periodic reports on the e-waste or plastic waste performance and compliance to the CPCB or the SPCBs or the concerned regulatory authority as per the prescribed frequency and format.
  • The applicant should conduct annual verification or validation of the e-waste or plastic waste performance and compliance by the CPCB or the SPCBs or any other authority and should submit the verification or validation report to the CPCB or the SPCBs or the concerned regulatory authority as per the prescribed frequency and format.
  • The applicant should display the EPR registration and the verification or validation report or the e-waste or plastic waste statement or the e-waste or plastic waste performance report or the e-waste or plastic waste compliance report or any other document that indicates the performance and compliance of the applicant with respect to the e-waste or plastic waste management at a conspicuous place at the office of the applicant or the website of the applicant or the CPCB or the SPCBs.
  • The applicant should cooperate with the inspection or verification or audit or investigation or inquiry or enforcement or adjudication or litigation or arbitration or mediation or conciliation or any other process or action initiated by the CPCB or the SPCBs or the concerned regulatory authority or the court or the tribunal or any other competent authority with respect to the e-waste or plastic waste management and should provide all the necessary information and documents and should implement all the directions or orders or decisions or awards or settlements or agreements or any other outcomes of such process or action.
